Terms of Service

These terms govern the use of Baktam by businesses outside Turkey. By creating an account or using the service you accept these terms on behalf of your business. If you do not agree, please do not use Baktam.

1. The service

Baktam is cloud software for vehicle workshops, operated by Fatih Bilgiç (“Baktam”, “we”). It covers job cards, vehicle intake, customers and vehicles, stock, sales, payments, reminders and reports, and is available through the web panel, the iOS and Android apps and an API. On the Enterprise plan, Baktam can also be installed on your own server. The service requires an internet connection; there is no offline mode.

2. Accounts and users

  • The person who opens the account confirms that they are authorised to act for the business.
  • You are responsible for the users you invite, the roles you give them and for keeping sign-in details secure.
  • You must give accurate business details, including your country, which determines currency, tax labels and document formats.

3. Free trial

New accounts get a 14-day free trial with the features of the Pro plan and a limited number of users. No payment is due for the trial. When the trial ends, access is limited to the licence page until a paid plan is activated; your data is kept in the meantime in line with section 6.

4. Plans, fees and billing

  • Plans (Micro, Pro and Enterprise), their limits and current prices are shown on the pricing page. For businesses outside Turkey, prices are in US dollars, billed monthly or yearly.
  • Subscriptions are invoiced and paid by bank transfer. Card payment is not currently available for international customers.
  • Prices exclude any taxes that apply to your purchase, which are added where required.
  • If a payment is overdue after a paid period ends, the account stays usable for a grace period of 7 days and is then limited to the licence page until payment is received.
  • We may change prices for future periods; we will give at least 30 days' notice before a new price applies to your renewal.

5. Third-party services

Some features work through providers you contract with directly, such as SMS through Twilio or WhatsApp Business (Cloud API) by Meta. Their terms and fees apply, and you are responsible for your sender IDs, registrations and message templates with those providers. Baktam is not responsible for the availability or charges of third-party services.

6. Cancellation and termination

You can cancel at any time. The service continues until the end of the period you have paid for, and fees for a period already started are not refunded unless required by law [to be confirmed]. After the account ends, you can request an export of your data for 60 days, after which the data is deleted.

We may suspend or terminate an account for a serious breach of these terms, such as unlawful use or an attempt to breach security. If we terminate without such a breach, we will refund the unused part of any prepaid fees.

7. Your data and your responsibilities

  • You own the data you enter into Baktam. We process it only to provide the service, as described in our privacy policy.
  • For your customers' and staff's personal data you are the controller and Baktam is your processor. You are responsible for having a lawful basis to record that data and to send messages to your customers, including any consent required for marketing messages.
  • You are responsible for the tax and legal content of the documents you issue. Baktam does not provide tax advice. In Saudi Arabia, Baktam can issue ZATCA (Fatoora Phase 2) e-invoices once you have onboarded your own e-invoicing unit; you remain responsible for that onboarding, for the data on each invoice and for meeting ZATCA's deadlines, such as reporting simplified invoices within 24 hours. Outside Saudi Arabia, documents produced by Baktam are not sent through Peppol or any other e-invoicing network, because those integrations are not available yet.

8. Acceptable use

You must not:

  • use Baktam for anything unlawful or to store content that infringes the rights of others;
  • send spam or unsolicited messages through the messaging features;
  • try to access other businesses' data, test or bypass security measures, or overload the service by automated means;
  • resell or copy the service, or reverse engineer it except where the law allows.

9. Availability and support

We provide the service with reasonable care and skill and aim for high availability, with a monthly uptime target of 99.5%. This is a target, not a guarantee [service level to be confirmed]. Planned maintenance is announced in advance where possible. Support is available by email at [email protected]; Enterprise customers receive priority support.

10. Intellectual property

The Baktam software, brand and content belong to Baktam. You receive a limited, non-exclusive right to use the service during your subscription. For self-hosted installations, the licence is valid only while the subscription is active.

11. Limitation of liability

The service is provided “as is” to the extent permitted by law. Baktam is not liable for indirect or consequential losses, loss of profit or loss of data caused by user error, for outages of the internet or third-party services, or for events beyond our reasonable control. Our total liability to you under these terms is limited to the fees you paid in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Changes to these terms

We may update these terms. We will notify account owners by email at least 30 days before significant changes take effect; if you do not agree, you may cancel before then.

13. Governing law and disputes

These terms are governed by [to be confirmed], and disputes will be decided by the courts of [to be confirmed], unless mandatory law in your country provides otherwise.
